The purpose of this Privacy Policy (this “Policy”) is to set out the manner in which Nourishing the Whole Person collects, uses, discloses and otherwise manages the Personal Information of clients and visitors to our website available at www.nourishingthewholeperson.com (the “Website” or “Site”).

"Personal Information" means information about an identifiable individual. An individual’s Personal Information includes his or her name and email address. However, it excludes business contact information when used to contact an individual in his/her business capacity, such as contact information disclosed on a business card.

The Site is intended for and directed to residents of Canada who have reached the age of majority in their jurisdiction of residence and can form legally binding contracts under applicable law.

In the course of its commercial activities, Nourishing the Whole Person ordinarily collects, uses, discloses, and stores Personal Information to facilitate focussed marketing materials. Nourishing the Whole Person may use third party online services to help with online booking that are Personal Information Protection and Electronic Documents Act (“PIPEDA”) compliant, and may disclose information that identifies its clients to such service providers for this purpose. Third party service providers may be located outside of Canada.

Specifically, we may collect Personal Information when an individual:

  • Visits our Website;

  • Creates an account;

  • Request an appointment through our online booking service provider;

  • Contacts us with a comment, question or complaint.

Sending Information Over the Internet

The transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk.


Data Collected for Client Accounts

You do not have to register or create an account to visit and browse certain features of the Website. However, in order to access our client services, you are required to create an account on our electronic charting system. We collect your first and last name, email address, phone number, physical address, DOB, and a password that you select in order to create your account, and for us to contact you about your upcoming appointment. Your personal and medical information that is collected during our sessions is stored in accordance to with PIPEDA.

Cookies

A cookie is a small data file which is sent from a web server to a web browser when that browser visits the server’s site.

We obtain information about your general internet usage by using a cookie file which is stored in the hard drive of your computer. Cookies help us to improve our Site and to deliver a better and more personalized service.

You may refuse to accept cookies by activating the setting on your browser which allows you to refuse the setting of cookies. Most browsers allow you to turn off cookies.

Credit Card Information

Nourishing the Whole Person does not collect or retain credit card information. The processing of all payments is outsourced to our third-party service provider, Jane Booking System. You should read and understand the privacy policy of any third-party service provider.

Customer Service

When you contact us with a comment, question or complaint, you may be asked for information that identifies you, such as your name, email address, address and phone number, along with additional information we need to help us promptly answer your question or respond to your comment or complaint. We may also retain this information to assist you in the future and to improve our customer service, product and service offerings, and events and promotions.

Legal Requirements

We may also disclose Personal Information or other information collected by Nourishing the Whole Person where necessary for the establishment, exercise or defence of legal claims, to detect, suppress or prevent fraud, and to investigate or prevent actual or suspected loss or harm to persons or property.

Retention

Nourishing the Whole Person retains Personal Information only as long as reasonably necessary for the fulfillment of the purposes for which such data was collected or otherwise meet valid legal or business requirements. When data collected is no longer required by Nourishing the Whole Person it is permanently deleted.

Nourishing the Whole Person cannot, however, guarantee that loss, misuse or unauthorized use of your personal data will never occur (for example, someone could conceivably overcome our security measures). We may require certain information for the purposes of verifying the identity of the individual seeking access to their Personal Information or other information.

Exclusive Jurisdiction

This Privacy Policy, and any matter applicable to your direct or indirect use of this Site, shall be governed by the laws of the Province of British Columbia and the Federal laws applicable in the Province of British Columbia. Any dispute shall be settled in the courts located in the Province of British Columbia, though the foregoing shall not limit the ability of Nourishing the Whole Person to seek injunctions and remedies in other jurisdictions which are required to stop continuing breaches of this Agreement.
